The Toxic Substances Control Act (TSCA) is a United States federal regulation administered by the Environmental Protection Agency (EPA) that regulates the manufacture, importation, processing, and distribution of chemical substances and mixtures. For Indian exporters, TSCA compliance is mandatory when exporting chemicals, chemical compounds, finished goods containing regulated substances, or products manufactured using controlled chemical processes to the United States market.
TSCA compliance under the FTP 2023-28 (Foreign Trade Policy 2023-28) and DGFT guidelines requires Indian manufacturers and exporters to ensure that exported chemical substances and products meet EPA's Pre-Manufacture Notice (PMN) requirements, Chemical Data Reporting (CDR) obligations, and specific substance restrictions including asbestos, polychlorinated biphenyls (PCBs), and other hazardous chemicals listed under the TSCA Inventory.
